Who We Are

Upright Health, Inc. ("Upright Health," "we," "us," or "our") is a California corporation located at:

This policy explains how we collect, use, and protect information when you visit uprighthealth.com (the "Site") or use our online training programs, coaching services, and community features (together, the "Services"). If you have questions about this policy, contact us at [email protected].

Information We Collect

Device, log, and security data. When you access the Site, our platform provider (Kajabi) and related infrastructure and security providers automatically process information such as your IP address, browser and device type, requested pages, referring page, timestamps, and diagnostic or security information. This happens regardless of your cookie choices below, because it's used to deliver the Site, secure it against abuse, and troubleshoot technical issues — it is not used by us for advertising.

Analytics data. Separately, and only if you consent, we use Google Analytics to understand how visitors use the Site in aggregate. See the Cookies section below for how this consent works.

Account data. If you create an account or purchase a program, we collect the information you provide, such as your name and email address. If you sign up for coaching, we may also collect your address to understand your general location.

Email and marketing data. If you subscribe to our email list, request a free resource, or purchase a product, we collect your email address and related subscription information. Purchasing a program or requesting a free resource automatically enrolls you in our promotional emails — this is not a separate opt-in. All of our email marketing is run through Kajabi, our platform provider, which may record whether an email was delivered, opened, or clicked. We use this information to send requested content, service messages, and promotional communications. You may unsubscribe from promotional emails at any time using the link included in each email; you may still receive transactional or account-related messages (such as purchase receipts) regardless of your marketing preference.

Transaction data. When you make a purchase, payment details are processed by our payment providers, PayPal and Kajabi Payments. We do not store full payment card numbers ourselves, but we may retain related records such as billing address, purchase history, transaction identifiers, and refund or dispute information for accounting, tax, and fraud-prevention purposes.

Communication data. If you contact us — including through our support chat, email, or the contact page — we collect the content of that communication and any information you choose to share in it.

Forum and community data. If you participate in our Kajabi Community or other interactive features, information you post — including your username, profile information, and content you submit — may be visible to other logged-in members. Please do not post personal, medical, or sensitive health information you do not want shared with other members. Community communications are not confidential and are not a substitute for professional medical advice. Community content may remain visible after you close your account when reasonably necessary to preserve the continuity of a discussion, though we will consider deletion requests.

A note on health information. Upright Health provides fitness and movement education only. We do not diagnose, treat, or provide medical advice. If you share health-related information with us (for example, describing pain or a physical condition in a support conversation or community post), we treat it as any other communication or community data described above — we do not use it for advertising or share it with advertisers. Some state laws (see "Consumer Health Data" below) define health information more broadly than most people expect, and we've addressed that separately.

Cookies and Tracking Technologies

The following describes the principal cookies and similar technologies used on the Site as of the date above.

Necessary (always on, not affected by your cookie choice)

  • Kajabi platform cookies — keep you logged in, remember your cart, and process checkout. Provided by our platform provider, Kajabi.
  • Google reCAPTCHA — our platform provider, Kajabi, uses Google's invisible reCAPTCHA to help protect the Site from spam and abuse. This runs automatically as part of Kajabi's underlying infrastructure. This site is protected by reCAPTCHA, and the Google Privacy Policy and Terms of Service apply.
  • HelpScout support widget — our "Get Help" button does not load or set any cookie until you click it. Once clicked, HelpScout may set a cookie to maintain your support conversation. This only happens if you choose to start a chat.

Embedded media (not yet gated by consent)

  • YouTube embedded videos — some course pages and blog posts embed videos hosted on YouTube. Loading a YouTube embed may allow Google to set cookies or collect data before you press play, governed by Google's Privacy Policy.

Analytics (requires your consent)

  • Google Analytics (GA4) — helps us understand how visitors use the Site so we can improve it. This does not run by default. When you first visit, a banner asks you to Accept or Reject. Analytics only loads if you click Accept. Your choice is remembered for 365 days. You can change your choice at any time using the "Manage Cookie Preferences" link available at the bottom of every page.

We do not use advertising or social media pixels (such as Meta/Facebook Pixel) on this Site.

Google Ads

We have linked our Google Analytics property with a Google Ads account. We may use this account, now or in the future, to run advertising campaigns for Upright Health, which could include personalized advertising or remarketing based on Site activity.

As of the date of this policy, we currently configure our consent system not to grant advertising-storage, advertising-personalization, or advertising-user-data consent for any visitor, regardless of your cookie choice above, and we do not currently use Site activity to create remarketing audiences or personalize advertising. If this changes — for example, if we begin running remarketing campaigns — we will update this policy and our consent controls accordingly, and where required by law, provide a clear opt-out mechanism before doing so.

Do Not Track and Global Privacy Control

Some browsers offer a "Do Not Track" setting. Because there is no universally accepted standard for responding to these signals, the Site does not currently respond to traditional Do Not Track signals. Because we do not currently sell or share personal information for cross-context behavioral advertising, there is no sale or sharing from which to opt out via signals such as Global Privacy Control.

How We Use Your Information

We use the information described above to:

  • Operate, maintain, and improve the Site and our Services
  • Process purchases and provide the programs, coaching, and community access you've signed up for
  • Respond to your questions and support requests
  • Send you service messages and promotional communications (see "Email and marketing data" above for how enrollment works)
  • Understand aggregate usage patterns (only where you've consented to analytics)
  • Maintain the security of our Site and Services and prevent abuse

How We Share Information

We do not sell your personal information. We share information only as follows:

  • PayPal and Kajabi Payments, to process your purchases and refunds
  • Kajabi, our platform provider, which hosts the Site and processes account, course, email marketing, and community data on our behalf
  • HelpScout, if you initiate a support conversation
  • Google Analytics, only if you've consented to analytics cookies
  • Google Ads, which is linked to our Google Analytics account; we do not currently import Site activity into Google Ads for remarketing audiences or personalized advertising
  • Google (via reCAPTCHA and YouTube embeds), as described in the Cookies section
  • Legal and safety purposes — if required by law, legal process, or to protect the rights, property, or safety of Upright Health, our users, or others
  • Business transfers — if we're involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction; we'll notify you if this happens

We do not sell or share personal information for cross-context behavioral advertising as those terms are defined under the California Consumer Privacy Act (CCPA/CPRA).

Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including providing purchased programs, maintaining business and transaction records, complying with tax and legal obligations, resolving disputes, preventing fraud, and enforcing our agreements. Retention periods vary depending on the type of information and the reason it was collected. Analytics consent cookies are retained for 365 days. Community content may remain visible after an account is closed when reasonably necessary to preserve the continuity of a discussion, but we will consider applicable deletion requests.

Your Privacy Rights

Privacy rights available to California residents

Depending on applicable law, you may have rights to:

  • Know what personal information we've collected about you
  • Delete personal information we hold about you
  • Correct inaccurate personal information
  • Opt out of the sale or sharing of personal information (we do not currently sell or share personal information, as described above)
  • Not be discriminated against for exercising these rights

To exercise these rights, contact us at [email protected]. We will verify your identity before fulfilling your request. We will honor requests described above regardless of whether every threshold for a particular law is met.

If you are located in the EEA or UK (GDPR)

You have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate data
  • Request deletion of your data
  • Restrict or object to certain processing
  • Request a copy of your data in a portable format
  • Withdraw consent at any time (for anything processed based on consent, such as analytics cookies)
  • Lodge a complaint with the data-protection authority in your country or region — though we encourage you to contact us first so we can try to address your concern

We rely on: performance of a contract to provide purchased products and account services; legitimate interests to secure, administer, and support the Services, and to market our own similar products to existing customers (sometimes called the "soft opt-in" rule), subject to your right to opt out at any time using the unsubscribe link in any promotional email; legal obligations to maintain required records; and consent for analytics cookies.

Because our infrastructure providers (including Kajabi, HelpScout, and Google) may process data in the United States, your information may be transferred outside the EEA/UK. We rely on our providers' applicable safeguards for these transfers.

Consumer Health Data

Some U.S. state laws define consumer health data broadly and may cover information you voluntarily provide about pain, mobility, physical conditions, symptoms, or similar matters. We use such information only to provide requested support, coaching, community features, or Services; respond to your communications; maintain safety and security; and comply with applicable law. We do not sell consumer health data or use it for targeted advertising. We disclose it only to service providers acting on our behalf, when you direct or authorize us to do so, or when required or permitted by law. To ask about, access, correct, or delete consumer health data you have provided, contact [email protected].

Children's Privacy

Our Services are not directed at children under 16, and we do not knowingly collect personal information from children under 16. If you believe a child has provided us with personal information, contact us at [email protected] and we will delete it.

Security

We use SSL encryption to protect the transmission of sensitive information on this Site. While this is standard practice, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security. If a data breach affects your personal information, we will provide notification as required by applicable law.

Changes to This Policy

We may update this policy from time to time to reflect changes in our practices or legal requirements. We encourage you to review this page periodically. Material changes will be reflected in the "Last updated" date above, and where required by law, we will provide additional notice.
